Norwegian Accident Investigation Board officials are blaming cargo terminal workers in Oslo as well as railway officials for the accident that occurred on March 24, 2010. The official report cited the terminal workers for failing to secure the car’s track brakes and the railway officials for putting in place acceptable standards for stopping runaway cars.
Sixteen (16) cars careened three and a half (3.5) miles downhill out of the cargo terminal before crashing into a port building. Three dock workers suffered death in this railway accident because of “lack of safety precautions.”
Accidents resulting in injury fall under the Federal Employers Liability Act – or FELA – in the States. FELA Law applies to injuries suffered on trains or railcars, in railyards, or on the railway/tracks itself. Santa Fe Train Derailment: This morning around 5:30am, a BNSF train carrying liquid petroleum unexpectedly encountered almost 20 cars jump the tracks. Officials have evacuated the area due to a leak of natural gas from the liquid petroleum. Vapors are NOT a major concern at this time.
Officials from Galveston, Hitchcock, Alvin, Dickinson, Galveston County and HazMat are on the scene as of now. Evacuations have been scaled back.
Train Accidents like this legally fall under a federal act known as FELA (Federal Employers Liability Act). This act requires employers to offer certain “standards” for their employees involved in any train/rail related jobs including ON the trains, ON the tracks or IN the railyards.
If you have been involved in a rail-related accident, the attorneys at Burwell Nebout Trial Lawyers handle all types of FELA claims and cases. Call today!
